Construction Site Overview

Construction work in Japan is regulated under the Construction Business Act. In principle, a company or individual carrying on construction business in Japan must obtain a Construction Business License, regardless of whether the work is for a public-sector or private-sector project.

A license may not be required where the business carries out only minor construction work. However, the applicable thresholds are limited, and the need for a license should be checked carefully before entering into construction contracts in Japan.

MAIN LICENSE CATEGORIES

MINISTER LICENSE OR GOVERNOR LICENSE

A Minister license is required where the applicant has construction business offices in two or more prefectures, while a Governor license applies where the applicant has construction business offices in only one prefecture.

 

This distinction is based on the location of the business offices, not the construction sites.

ORDINARY OR SPECIFIC CONSTRUCTION BUSINESS LICENSE

An Ordinary Construction Business License is the standard license.

 

A Specific Construction Business License is required where the main contractor directly contracts with the client and subcontracts work totaling JPY 50,000,000 or more (or JPY 80,000,000 or more for general building construction work).

CONSTRUCTION WORK CLASSIFICATION

Construction Business Licenses are granted by construction work category. There are 29 classifications, and the applicant must obtain the classification that matches the work it will actually perform.

More than one classification may be required depending on the business model.

APPLICATION PROCESS

The exact process depends on the license type, construction work classification, applicant structure, personnel qualifications, financial status and competent authority, but the general process is as follows.

REQUIREMENT CHECK AND LICENSE STRATEGY

We review the planned construction activities, business office structure, contract model, subcontracting plan and construction work classifications. Based on this review, we identify the appropriate license type, construction work classification and application route, including whether the applicant should apply for an Ordinary or Specific Construction Business License.

DOCUMENT PREPARATION

We assist with preparing and collecting the documents required for the application, including documents relating to officers, management experience, full-time engineer qualifications, financial basis and business office information.

AUTHORITY COORDINATION

Where appropriate, we coordinate with the competent authority before filing, especially where the applicant’s personnel experience, business model or supporting documents require prior confirmation.

APPLICATION AND REVIEW

We assist with filing the application and responding to additional requests from the competent authority during the review process.

LICENSE ISSUANCE AND POST-LICENSE SUPPORT

After the license is issued, we assist with post-license procedures where required, including change notifications, renewal applications and addition of construction work classifications.

GOVERNOR LICENSE

Additional fees may apply where the qualification or experience of the technical manager must be established through extensive documentary evidence.
